Booking
A contract exists when you have paid a deposit and we have accepted and confirmed your booking in writing or by email. The applicant accepts these conditions on behalf of all the members of the party. Only persons named on the booking form are entitled to use the property.
Property Protection Fee (PPF)
The sending of the booking form confirms your acceptance to pay the Property Protection Fee of £34/$54, which will cover Accidental or Inadvertent Damage to our home.
Intentional Damage or Gross Negligence, excessive cleaning costs, excessive use of electricity (caused by leaving external doors open with the air conditioning on), will result in additional costs billed to a credit card that will be kept on file by our Management Company.
The named person on the booking form will be required to call into Award Vacation Homes office within 24 hours of arrival to provide identification and a credit card in the event of gross negligence not covered by the PPF.
Cancellations
Any cancellation of a booking must be in writing and is subject to the following cancellation charges:-
 More than 11 weeks prior to your arrival date - full deposit
 Between 4-10 weeks prior to your arrival date - 50 percent of rental cost
 Less than 4 weeks prior to your arrival date – 100 percent of rental cost
If we have to cancel your booking due to events beyond our control, we will do our best to find you alternative accommodation with our US Management Company. However, we cannot accept any liability whatsoever in respect of any loss or damage sustained by the hirer in these circumstances.
Responsibilities
The party must treat the property and its furniture, fittings, utensils and other facilities with respect. Any loss or damage must be reported immediately to the Management Company. The applicant must make good or pay for any loss, damage or breakage. The owners reserve the right to withhold any monies from the security bond in order to recover any loss.
All guests including children must have their own full 10 year passport with at least 6 months remaining after your trip.
Swimming Pool / Hot Tub
As the property has a swimming pool & hot tub, the owners do not accept liability for injury caused as a result of the use of the pool. Guests are specifically requested not to allow unsupervised children to use the pool, which is around 5 feet deep at the deepest end. There is a safety fence fitted around the pool and we strongly recommend that this is used.
Smoking/Pets
For the safety and comfort of all our guests smoking is not permitted within the property. No pets are allowed.
Cleaning
The property is cleaned prior to your arrival and after you have departed. Although it will be cleaned, we ask that you leave it in an orderly state and all kitchen utensils should be washed. Should the property require extensive cleaning then the owners reserve the right to withhold any monies from the security bond to pay for the extra cleaning.
Arrival and Departure
The villa will be available for occupancy from 4.00pm on the date of arrival and must be vacated by 11.00am (prompt) on the day of departure.
Insurance
We strongly recommend that you take out holiday insurance, prior to your holiday dates that will enable you to recover any deposit/rental payment, should circumstances make it impossible for you to travel, whether through ill health or cancellation by the Airlines, or the owners. Any claims should be directed to the respective Insurance Company.
Force Majeure
The owners of the property will not be liable for loss or delay occasioned by any of the following:- Strikes, Riots, Political Unrest, Hostilities, War, or threat of War, Terrorist Activity, Hurricanes/Tornados, Closure of Airports or any other event beyond the owners control.
Problems
In the unlikely event that you experience any problems with our property, you must contact our Management Company immediately, who will do their best to assist you. They do operate a 24 hours call out.
The owner will not be liable for the loss or delay caused by conditions over which they have no control. We cannot be held responsible for any mechanical breakdown during your stay, although every effort will be made to rectify any problems as quickly as possible.
Climate
The applicant is hereby made aware that as Florida is a tropical climate it is the home of many insects etc. All homes are treated on a regular basis to repel such unwanted visitors, but inevitably they occasionally will find there way inside properties from time to time. In order to minimise this please keep doors closed at all times, this will also allow the air conditioning unit to function more efficiently.
Code of Conduct
Orange Tree is a residential community. The actions of all members of your party should not interfere with the enjoyment of either other holidaymakers or the residents of Orange Tree. Please do not use the swimming pool, play loud music or engage in any activity which may cause inconvenience to your neighbors after 10.30pm or before 07.30am. In the event that any member of your party behaves in a way that is likely to cause distress, danger or annoyance to any other holidaymakers, residents of Orange Tree or damage to any property, the owners or their management company reserve the right to terminate your rental agreement immediately and forthwith. The owners or their management company will not be liable for any costs you will incur, nor shall we pay any compensation, nor make any refunds due to this action.
Disclaimer
The Villa is privately owned and neither us or our Management Company accept any liability whatsoever for personal injury, accidents, loss or damage to persons or personal effect however caused.
Villa Description
Whilst all information supplied is deemed to be correct and to the best of our knowledge, it is understood that the information supplied is in good faith, but is for guidance purposes only and does not form any part of the contract entered into.
Law
This contract is subject to and shall be constructed with the laws of England and the parties hereby submit to the exclusive jurisdiction of the English Courts.
