TERMS & CONDITIONS WITH RIGHT CHOICE VILLAS
Your responsibility: the party must treat the property; it’s furniture, fittings, utensils and other facilities with respect. Any loss or damage must be reported immediately to the Management Company. The applicant must make good or pay for any loss, damage or breakage caused during the stay. The owners reserve the right to withhold any monies from the security deposit to pay for any loss or damage caused to the property or its contents by any member of the party. The contract is between the property owners and the party leader who must sign the booking form accepting the conditions on behalf of all persons named on the booking form, including those substituted or added by agreed amendment of the booking. A contract exists when you have paid a deposit and we have accepted and confirmed your booking in writing. The applicant accepts these conditions on behalf of all the members of the party. Only persons named on the booking form are entitled to use the property.
1. ARRIVAL at the property (unless otherwise advised to you in writing) should be after 5:00pm local time. The property must be vacated by 10:00am on the day of departure. Late checkouts will be charged a full day’s rental.
2. CANCELLATION: Any cancellation or amendment of booking must be made in writing and is subject to the following cancellation charges:
o More than 10 weeks prior to your arrival date – full deposit.
o Between 8 and 10 weeks prior to your arrival date – 50% loss of deposit.
o 8 weeks prior to your arrival the payment will be due in full – 100% loss of invoice total.
If full payment and Security deposit is not received prior to your departure date, the Owner reserves the right to consider the booking cancelled and any monies paid will be non-refundable.
The Owner reserves the right to cancel and refund all funds paid.
3. FORCE MAJEURE: The owners of the property or their servants or agents will not be liable for loss
Or delay occasioned by any of the following: Strikes, Riots, Political Unrest, Hostilities, War, or threat of War, Terrorist Activity, Closure of Airports or any other event beyond the owners’ control.
4. SECURITY BOND: A bond of £200.00 will be held on behalf of the owners against loss or damage occasioned by the use of the property by the parties to this agreement. The bond will be fully refundable (within 2 weeks of vacating the villa) after a satisfactory status report has been received and the keys returned to their owner or agent. If any damage or loss reported exceeds the £200.00 Security Deposit, the owner reserves the right to claim this from the Guest. The Guest agrees to pay the full cost of any breakages, loss or damage to the property. The Owners Management Company shall be the sole arbitrator on the cause of damage or loss.
5. POOL: As the property has a swimming pool, the owners and the owner’s agents do not accept liability whatsoever for any injury howsoever caused as a result of the use of the pool. Guests are specifically requested NOT TO ALLOW UNSUPERVISED CHILDREN TO USE THE POOL, which is around five feet deep at the deepest part. Please also note that the homes with tiled floors can be slippery when wet, take extra care when entering the home especially from the pool area.
6. The owner, Management Company or their agent will not be liable for any loss or damage of personal property, personal injury in the home or on the property. It is recommended that the guests have appropriate travel/holiday insurance in force for the period of the trip.
7. CLEANING: The rate paid includes cleaning of the property prior to your arrival and after you have departed only. In the event you require cleaning any time during your stay beside that of which has been stated in these conditions, a special request must be made and an additional fee must be paid. Although the property will be cleaned after your departure it must still be left in an orderly state and all kitchen utensils should be washed. Should the property require extensive cleaning, then the owners or their booking agent reserve the right to withhold any monies from the security deposit to pay the extra cleaning.
8. PROBLEMS: Any complaints related to the accommodation must be made in writing to the owners Management Company within 24 hours of any problem arising, who will endeavour to put things right. Unless there is a valid reason we will not consider the owner, their agents or representatives liable for any complaint that was not initially registered with the Florida representative during your stay.
9. The applicant is hereby made aware that on many Estates there will be other homes under construction. The owners, their agents or representatives will not accept liability for complaints arising from construction.
10. The owner, Management Company or their agent will not be liable for any loss or delay caused by conditions over which they have no control. The owner, Management Company or their agent will not be liable for any loss due to noise or disturbance from anywhere within the vicinity of the rental property.
11. CLIMATE: The Applicant is hereby made aware that, as Florida is a tropical climate it is the home of many insects etc. All homes are treated on a regular basis to repel such unwanted visitors, but inevitably they occasionally will find their way inside properties from time to time. They are best eradicated by spraying with an appropriate product.
12. POOL HEAT: Pool heating is charged as an optional extra. We do not guarantee pool temperatures.
13. KEYS: Upon final payment for your holiday, you will be provided with the access code for the coded lock box of the property, which will contain the keys. Guests are asked to look after the keys as if they were their own. If the keys are mislaid, the Guest is required to obtain another set from the Management Company at a charge of £50.00.
14. Only those persons identified on the booking form are authorised to use the property. The Management Company must be made aware of any changes to the original name list on the booking form. The maximum number of guests in the villa is 10 with the condition that all persons sleep in the bedrooms/beds provided.
15. BOOKINGS: Bookings are only valid after the booking form has been completed, signed and received by the owner, Management Company or their agent, along with the appropriate deposit and/or full payment and the Owner has confirmed the booking in writing. The person who signs the booking form certifies that he/she is authorised to accept the Terms and Conditions on behalf of all parties included on the booking form, including those added or subtracted at a later date. The signatory must be a member of the party occupying the Villa and must be over 21 years of age.
16. BBQ: Guests are invited to use the BBQ under the condition that it is cleaned after use. Should it require cleaning upon your departure, a charge will be withheld from the security deposit to pay for the extra cleaning.
17. English Law will settle disputes.
18. The maximum number of guests is 10 persons.
19. No pets allowed.
20. No smoking is permitted in the villa.
