Terms & Conditions Florida Rose Villa

Your Reservation

The sending of the on-line booking form confirms your acceptance of the terms and conditions set out below and as may from time to time be changed and shall be binding on all persons stated on the booking form. To comply with Florida State Fire Regulations the maximum occupancy of ten persons including children may sleep in the property on any night. Florida Rose Villa is registered with the state authorities and is in full compliance with all relevant legislation and is fully licensed for short-term rentals and tax gathering in Florida.
Use of Florida Rose Villa

You have the use of the Villa and its facilities except pool and spa heating. If you require pool and / or spa heating a supplement is required with the final payment. Your holiday home is cleaned and prepared for your arrival. All bed linen and towels are supplied, however it is up to you to change bed linen and / or wash towels and to keep the villa clean during your stay. All taxes are included in the rental price.
Restrictions of Use

* No bookings will be accepted from parties where the guests are ALL less than 21 years old
* No sub-letting is permitted
* No pets are allowed. This includes but is not limited to, Birds, Fish, Mammals and Reptiles
* No Smoking
* No commercial vehicles, campers, mobile homes, recreational vehicles, motor homes, house trailers or boats are to be parked or stored at any place on the property
* No glass or crockery is to be taken onto the pool area at any time

Rental Period

The rental period will normally be from Saturday to Saturday beginning at 4 p.m. local time on the first day of occupation specified in the reservation form and the property must be vacated by 11 a.m. local time on the last day of occupation on the reservation form. Other periods may be available on request. Early arrival or late departures may be possible. Contact us for information.
Payment

Payments are accepted by cheque/check in GB Pounds or US Dollars by Wire Transfer or Credit Card. (Credit Card payments will be subject to a 3.5% administration charge. Wire Transfers will incur an administration charge)
To Secure a Booking

A non-refundable reservation cheque / check or a Credit Card payment for £150.00 or the equivalent in USD for each week booked, must be made, and the completed, signed reservation form returned, to us within seven days in order to reserve your dates. Once we have received the reservation form and the cheque has cleared, we will confirm your dates and will send you a receipt and confirmation of your booking. It will not be possible to hold the dates requested after the seven day time limit has expired. The full balance must be paid by cheque/check, Wire Transfer or Credit Card 10 weeks before the occupation date or later by arrangement with the owner.
Security Deposit

In addition to the reservation payment, a refundable security / damages deposit of £250.00 or the equivalent in USD will be required with the final payment for each booking. This deposit will be refunded to you by cheque, in the currency in which it was paid, usually within 28 days of you leaving the Villa, subject to confirmation by the management company that no damage or loss has been suffered at the property,

We reserve the right to retain the security deposit (in part or in whole) to cover damage or loss, including non-return of keys or excessive use of utilities. In the unlikely event that such a retention is required due to damage or repair, receipts for repairs / replacements will be provided by us. The clients are solely responsible for any damage, breakages or loss that may be caused to the property or its contents, including keys.

The lead guest must fully inspect the home and report any damage or deficiency to the management company within the first 24 hours of arrival at the home.

Thereafter, any damage or deficiency found following the guests departure will be attributable solely to the lead guest and their party.

Florida Rose Villa is a designated “no smoking” home and all guests agree to refrain from smoking in the property or on the pool area. In the event that neutralization of smoke odours from cigarettes, cigars, pipes or any other smoking materials is required, or in the event that burn marks from cigarettes, cigars, pipes or any other smoking materials is detected, the cost for elimination of those odours or repairs to burn marks will be deducted from the security deposit. Our local management company checks the home before you arrive and after you leave and will advise us of any additional cleaning cost for removal of stains due to spillage. In the event of any excessive cleaning costs or excessive use of utilities (e.g. leaving the external doors open with the air conditioning on), that exceeds the security deposit, the signatory will be held responsible for all additional costs.

We will pursue under U.K. law, any guest for recompense for any damages caused that may exceed the value of the security deposit and will require payment within 14 days of being served notice of this.
Safety and Security

The swimming pool and spa are used entirely at guests' own risk. No diving is allowed.

Children MUST be accompanied and supervised at ALL times in the pool area.

The pool safety screen must be securely in place when the pool is not in use.

Florida has a sub tropical climate and care must be taken with food that is left uncovered. Uncovered food can attract insects very quickly and any additional pest control services may be passed on to you. It is a condition of the booking that the fitted alarm(s) be used when the house is empty.
Internet

A high speed WiFi Internet connection is provided for the guests. This is a FREE service. We will endeavour to ensure that this service is available for use. We cannot be held responsible for any failures or non-availability of communication lines, hardware or software. Signing the reservation form is a contract between each party member listed on the form and us. Within the terms of this contract you, and every party member agrees not to download or save, any pornographic, obscene, illegal or otherwise offensive material and abide by the user instructions in the home.
Insurance

It is essential that you ensure that each member of the party has adequate insurance cover. Check that any policies you are considering do in fact cover you for rented accommodation that is booked independently of travel agents and that it covers you and them for medical expenses, repatriation and cancellation.
Cancellation by Guests

In the event that you cancel your reservation for any reason, the following conditions will apply:

Any cancellation within the final 8 weeks will, regrettably result in the loss of the whole booking fee (not including the security deposit). It is the responsibility of the signatory to ensure that the signed cancellation letter reaches the owner. E-mails are not acceptable.

Failure to pay the final balance by the date due, 10 weeks prior to arrival, or later by arrangement with the owner, may result in the loss of the booking and the deposit. If we do not receive payment, we will attempt to contact the guest but if we receive no payment or communication, then unfortunately we reserve the right to cancel the booking and recover the balance owing. If you do have a problem PLEASE contact us as soon as possible to discuss the matter.
Cancellation by the Owners

In the unlikely event that personal circumstances necessitate cancellation of the booking, we will refund all monies paid by the party (without interest, compensation or consequential loss of any kind) However, the management company will always seek to relocate your booking to a home of similar or superior standard.
Disclaimer

Neither ourselves nor the management company accept any liability whatsoever for any of the following:

* Any electrical or mechanical failure to any machine, e.g. pool related equipment, air conditioning equipment, domestic appliances, water heater
* Personal injury or accidents occasioned by the guests or their visitors at the property, in the pool, spa or grounds, however caused
* Loss or damage to possessions or effects brought onto the property, including motor vehicles
* Medical expenses, however incurred
* Illness, hospitalisation or death

It is the responsibility of the party to exercise a duty of care at all times and party leaders should ensure that all their party follow the comprehensive operational and safety instructions relating to the use of facilities and equipment, familiarize themselves with the fire procedure displayed in the home and confirm that all persons using the home are adequately covered by appropriate personal accident, injury, public liability insurance.

The owners and their agents reserve the right of entry at any time, (including pool maintenance workers, gardeners and related trades)
Force Majeure

The owners and their agents accept no responsibility or liability for any loss or damage or alterations to the terms of this booking caused by events beyond the owners’ control including, but not limited to, war, civil commotion, flight delays or cancellations, technical difficulties with transportation, alteration or cancellation of schedules by carriers, adverse weather conditions, fire, flood, industrial dispute or any other event beyond our control.
Departure Details/Keys

Approximately one month prior to your arrival you will be provided with the directions from Orlando or Sandford airport to Florida Rose Villa and information regarding access to the Villa keys.
